Terms of Service

By creating an account or using the NexMind AI platform ("the Service"), operated by Variable Solutions, you agree to these terms.

1. The Service

NexMind AI provides pay-as-you-go access to third-party AI models (OpenAI, Anthropic, Google, Groq, OpenRouter, Mistral), a wallet billing system, and a WhatsApp AI agent for clinics and pharmacies. We may add, remove or change models and features at any time.

2. Accounts

You must provide accurate registration details and keep your credentials secure.
You are responsible for all activity under your account.
One person may hold multiple accounts only with our written consent.

3. Wallet & billing

Top-ups are prepaid credits. They never expire and are non-refundable except where required by law.
Each AI request is metered and billed at the model's published per-token rate. Free-tier models are not billed.
If your balance reaches zero, paid-model requests are blocked until you top up.
We may suspend or close accounts used for fraud, abuse or chargebacks.

4. Acceptable use

You agree not to use the Service to: generate illegal, harmful or deceptive content; attempt to bypass billing or rate limits; probe, scrape or disrupt the platform; or use the Service in violation of any applicable law. AI output is generated by third-party models and may be inaccurate — you are responsible for how you use it, including any medical, legal or financial decisions.

5. WhatsApp agent

The WhatsApp agent books appointments and reports stock from real business data. It is not a medical professional and never provides clinical advice; medical or urgent queries are handed to human staff. Availability and stock are subject to change.

6. Intellectual property

The Service and its branding belong to Variable Solutions. You retain rights to the content you submit. You grant us a licence to process your content to provide the Service.

7. Limitation of liability

The Service is provided "as is". To the maximum extent permitted by law, Variable Solutions is not liable for indirect, incidental or consequential damages, or for losses arising from AI output, service interruptions, or third-party provider failures. Our total liability is limited to the amount you have paid us in the 30 days before the claim.

8. Termination

You may close your account at any time. We may suspend or terminate accounts that breach these terms. On termination, unused credits are forfeited except where required by law.

9. Changes

We may update these terms from time to time. Continued use of the Service after changes are posted constitutes acceptance.
